TERMS OF SERVICE
1. ACCEPTANCE OF TERMS
By accessing, using, or engaging with the services provided by Price Compass ("Price Compass," "we," "us," or "our"), you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Price Compass.
If you do not agree to these Terms, you must not use our services or access our website. Your continued use of our services following any changes to these Terms constitutes acceptance of those changes.
These Terms apply to all users of our services, including without limitation users who are browsers, clients, customers, and any other contributors of content or information.
2. SERVICE DESCRIPTION
Price Compass provides strategic home pricing guidance utilizing comprehensive market data analysis. Our services are designed to assist homeowners, prospective sellers, and real estate professionals in making informed pricing decisions.
Our core services include:
Home Pricing Strategy: We analyze your property characteristics, local market conditions, economic indicators, and comparable properties to develop customized pricing strategies tailored to your specific goals and circumstances.
Comparative Market Analysis: We provide detailed analysis of recently sold properties, active listings, and expired listings in your area to establish accurate market value ranges for your property.
Offer and List Price Guidance: We deliver data-driven recommendations for setting list prices or evaluating purchase offers based on current market dynamics, property conditions, and timing considerations.
Our services are advisory and consultative in nature. Price Compass provides information, analysis, and recommendations but does not act as a real estate broker, agent, appraiser, or legal advisor. We do not list properties, facilitate transactions, or provide formal appraisals. Our analyses and recommendations are intended to inform your decision-making process and should be considered as one component of your overall real estate strategy.
The specific scope, deliverables, timeline, and pricing for services will be outlined in separate service agreements or engagement letters provided to each client.
3. USER OBLIGATIONS
By using our services, you agree to the following obligations:
Accurate Information: You will provide complete, accurate, and truthful information about your property, financial situation, goals, and any other relevant factors. You understand that the quality and accuracy of our analysis depends substantially on the information you provide.
Property Access: When applicable, you will provide reasonable access to the property for evaluation purposes, including scheduling viewings and providing documentation such as floor plans, previous appraisals, inspection reports, and disclosure statements.
Timely Communication: You will respond to our requests for information and clarification in a timely manner and will notify us promptly of any material changes to your circumstances or property that may affect our analysis.
Lawful Use: You will use our services only for lawful purposes and in accordance with these Terms. You will not misrepresent your identity, provide false information, or use our services for any fraudulent or illegal purpose.
Confidentiality: You will maintain the confidentiality of any login credentials, account information, or proprietary methodologies disclosed to you and will not share such information with unauthorized third parties.
Independent Verification: You acknowledge that our services provide guidance and recommendations, not guarantees. You agree to conduct your own due diligence, consult with appropriate professionals including real estate agents, attorneys, and financial advisors, and make independent decisions regarding your real estate transactions.
Prohibited Uses: You will not use our services or materials to compete with Price Compass, reverse engineer our methodologies, or reproduce, distribute, or commercialize our reports or analyses without express written permission.
4. APPOINTMENT SCHEDULING AND CANCELLATIONS
Scheduling: Appointments for consultations, property evaluations, and strategy sessions may be scheduled through our website, email, or other designated communication channels. All appointments are subject to availability and confirmation by Price Compass.
Confirmation: You will receive confirmation of scheduled appointments via email or phone. It is your responsibility to ensure we have current contact information and to verify appointment details.
Cancellations by Client: If you need to cancel or reschedule an appointment, you must provide notice at least 24 hours in advance of the scheduled appointment time. Cancellations made with less than 24 hours notice may result in cancellation fees as specified in your service agreement.
No-Show Policy: Failure to appear for a scheduled appointment without prior notice constitutes a no-show and may result in forfeiture of any deposit or prepayment and may incur additional fees equal to the full appointment value.
Cancellations by Price Compass: We reserve the right to cancel or reschedule appointments due to emergencies, illness, or circumstances beyond our control. In such cases, we will make reasonable efforts to notify you as soon as possible and will work with you to reschedule at no additional charge.
Rescheduling: Appointment rescheduling is subject to availability. We will make reasonable efforts to accommodate rescheduling requests, but cannot guarantee availability at your preferred time.
5. PAYMENT TERMS
Pricing: Service fees will be communicated to you prior to engagement and may vary based on property type, complexity, scope of analysis, and geographic location. Current fee schedules are available upon request.
Payment Methods: We accept payment via credit card, debit card, electronic bank transfer, and other methods as specified during the engagement process. Payment processing is handled through secure third-party payment processors.
Payment Schedule: Unless otherwise specified in your service agreement, payment terms are as follows:
- Initial consultations may require payment in full at the time of scheduling
- Comprehensive analysis services may require a deposit of 50% upon engagement with the balance due upon delivery of the final report
- Ongoing advisory services may be billed monthly or according to a payment schedule outlined in your service agreement
Due Dates: Invoices are due within 15 days of the invoice date unless otherwise specified. Services may be suspended or terminated for accounts with overdue balances.
Late Payments: Past due balances may be subject to late fees of 1.5% per month (or the maximum amount permitted by law, whichever is less) and may be referred to collections. You are responsible for all costs of collection, including reasonable attorney fees.
Refund Policy: Deposits and payments are generally non-refundable once services have commenced. If you are dissatisfied with our services, please contact us immediately so we can address your concerns. Refund requests will be evaluated on a case-by-case basis at our sole discretion.
Disputes: If you dispute any charges, you must notify us in writing within 10 days of the invoice date. Failure to dispute charges within this timeframe constitutes acceptance of the charges.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Price Compass and its owners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, loss of revenue, loss of business opportunity, loss of use, or loss of data arising out of or in connection with our services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claims arising out of or related to our services shall not exceed the total amount paid by you to Price Compass for the specific services giving rise to the claim during the three months immediately preceding the event giving rise to liability.
Price Compass is not liable for:
- Decisions you make based on our analysis, recommendations, or guidance
- Market fluctuations, changes in property values, or economic conditions that differ from projections or expectations
- Actions or omissions of third parties, including real estate agents, buyers, sellers, lenders, or appraisers
- Inaccuracies resulting from incomplete or incorrect information provided by you or third parties
- Technical failures, data breaches, or unauthorized access to information beyond our reasonable control
- Changes in laws, regulations, or market conditions occurring after our analysis is delivered
- Your failure to follow recommendations or seek additional professional advice
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
7. WARRANTY DISCLAIMERS
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
Price Compass does not warrant or guarantee that:
- Our analyses will result in successful property sales at any particular price or within any particular timeframe
- Property values will remain stable or increase
- Market conditions will develop as projected or anticipated
- Our recommendations will achieve your specific objectives or goals
- Our services will be uninterrupted, timely, secure, or error-free
- Any errors or deficiencies will be corrected
- Our reports are free from omissions or will include all factors that may affect property values
Professional Limitations: Price Compass is not a licensed real estate brokerage, appraisal service, legal firm, or financial advisory service. Our analyses are based on available market data, statistical modeling, and professional judgment, but are not formal appraisals, legal opinions, or financial advice. You acknowledge that:
- Our pricing guidance does not constitute a formal appraisal and should not be used for lending, taxation, or legal purposes
- Market data may contain inaccuracies, omissions, or delays
- Real estate markets are inherently unpredictable and subject to numerous variables beyond our control or analysis
- Past market performance does not guarantee future results
You are solely responsible for determining the suitability of our services for your purposes and for making final decisions regarding property pricing, listing, offers, and transactions.
No Fiduciary Duty: Price Compass does not assume any fiduciary duty to you beyond providing the services described in your service agreement. We are not responsible for protecting your interests in negotiations or transactions with third parties.
8. INTELLECTUAL PROPERTY
All content, materials, reports, analyses, methodologies, algorithms, software, databases, graphics, designs, and other intellectual property provided by Price Compass remain the exclusive property of Price Compass and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the reports and materials we provide solely for your personal, non-commercial purposes in connection with your real estate decisions. You may not:
- Reproduce, distribute, modify, or create derivative works from our materials
- Use our materials for commercial purposes or competitive analysis
- Remove or alter any copyright, trademark, or other proprietary notices
- Share detailed methodologies or proprietary analysis techniques with third parties
- Use our name, logo, or branding without express written permission
You may share our reports with your real estate agent, attorney, financial advisor, or other professionals directly involved in your transaction, provided they agree to maintain confidentiality and use the information solely for advising you.
9. CONFIDENTIALITY AND DATA PRIVACY
Price Compass recognizes the sensitive nature of the information you provide and is committed to maintaining confidentiality in accordance with applicable privacy laws.
Information Collection: We collect personal information including your name, contact information, property details, financial information, and transaction objectives necessary to provide our services.
Information Use: We use your information solely to deliver services, communicate with you, improve our offerings, and fulfill legal obligations. We do not sell your personal information to third parties.
Information Sharing: We may share your information with service providers who assist in delivering our services (such as data providers and payment processors), with your real estate professionals at your direction, or when required by law.
Data Security: We implement reasonable security measures to protect your information from unauthorized access, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Your Responsibilities: You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

10. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Price Compass operates, without regard to its conflict of law provisions.
Any disputes arising out of or related to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights or confidential information.
You agree to waive any right to a jury trial and to participate in class action lawsuits related to our services.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Price Compass and its owners, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of our services
- Your violation of these Terms
- Your violation of any rights of another party
- Any inaccurate or misleading
